1. Purpose

These Terms and Conditions of Use (hereinafter "TCU") govern access to and use of the Mariages.io platform.

Mr. Amine Mouad, in his capacity as Manager of the company MARIAGESDOTIO SARL.

Hosting Provider

The website and application are hosted by Amazon Web Services (AWS), located at 410 Terry Avenue North, Seattle, WA 98109, United States.

By accessing or using the Platform, the User agrees to be bound by these TCU in their entirety.

If you do not agree with any part of these TCU, you must refrain from using the Platform.

2. Definitions

"Platform": the Mariages.io website and mobile application.

"Couple": any natural person registered on the Platform to plan their wedding.

"Professional": any natural or legal person registered on the Platform to offer their wedding-related services.

"User": any person using the Platform, whether a Couple or a Professional.

3. Services Offered

The Platform offers a set of features designed to facilitate wedding planning and the connection between Couples and Professionals:

• Search and filter wedding vendors by category, city, and budget
• Send contact requests to Professionals
• Receive and compare quotes
• Electronic signature of contracts
• Secure online payment
• In-app messaging between Couples and Professionals

Wedding planning tools (budget, checklist, guest list, AI-powered wedding assistant).

For Professionals: showcase profile, contact request management, creation of quotes/invoices/contracts, payment receipt, wallet, statistics.

Mariages.io reserves the right to modify, add, or remove features at any time without prior notice.

Some features may be subject to a paid subscription for Professionals.

Mariages.io does not guarantee the availability of all features at all times.

The use of certain features may be subject to additional specific terms and conditions.

4. Registration and Account

Registration is free for Couples. Professionals must subscribe to a paid plan to access all features.

Users must provide accurate and up-to-date information during registration.

Each User is responsible for maintaining the confidentiality of their login credentials.

Mariages.io reserves the right to suspend or delete any account that violates these TCU.

5. Pricing and Payment

Prices of Professional subscriptions are displayed inclusive of all applicable taxes on the Platform.

Payments are processed securely via Stripe.

Terms for the wallet, credits, and refunds are detailed in the Payment and Wallet Terms.

Mariages.io reserves the right to modify its pricing at any time. Users will be notified of any pricing changes.

Any subscription in progress will remain at the contracted rate until its renewal date.

6. Quotes, Invoices, and Contracts

Professionals can create and send quotes, invoices, and contracts to Couples via the Platform.

These documents are governed by the following rules:

• Quotes are valid for the period specified by the Professional.
• Invoices must comply with applicable legal requirements.

Mariages.io provides the tools but is not a party to contracts between Couples and Professionals.

7. In-App Messaging

The Platform offers an in-app messaging system enabling Couples and Professionals to communicate.

Messages are stored on our servers for the duration of the account.

Mariages.io reserves the right to moderate messages and to delete any inappropriate content.

It is prohibited to use the messaging system to transmit illegal, defamatory, discriminatory, or inappropriate content.

8. User Obligations

Users agree to:

• Use the Platform in accordance with its intended purpose
• Not publish illegal, defamatory, or inappropriate content
• Respect the intellectual property rights of Mariages.io and other Users
• Not attempt to circumvent the Platform's security systems

Each User is solely responsible for the content they publish on the Platform.

9. Prohibited Conduct

The following conduct is strictly prohibited:

• Creating a false or misleading account
• Using the Platform for purposes other than those for which it is intended
• Collecting personal data of other Users without their consent
• Attempting to access the accounts of other Users
• Disrupting the proper functioning of the Platform
• Publishing content that infringes the rights of third parties
• Using the Platform for illegal purposes
• Attempting to decompile, reverse engineer, or extract the source code of the Platform
• Using the Platform to send unsolicited commercial communications (spam)

10. Intellectual Property

All content on the Platform (texts, images, logos, source code, design) is the property of Mariages.io or its partners.

Any reproduction, distribution, or use without prior written authorization is strictly prohibited.

Content published by Users remains their property, but they grant Mariages.io a non-exclusive, worldwide, royalty-free right of use for the purposes of operating the Platform.

This right of use includes the right to reproduce, display, adapt, and distribute the content on the Platform and associated media.

11. User-Generated Content

Users are solely responsible for the content they publish on the Platform (photos, descriptions, comments, messages).

By publishing content on the Platform, the User grants Mariages.io a license to use this content for the purposes of operating the Platform, including:

• Display on the Platform
• Promotion of the Platform on social media and associated media

The User warrants that:

• They have all necessary rights to the content they publish
• The content does not infringe any third-party rights
• The content complies with applicable laws and these TCU
• The content is not misleading or deceptive

Mariages.io reserves the right to remove any content that violates these TCU without prior notice.

Mariages.io does not guarantee the accuracy, quality, or reliability of user-generated content.

12. Reviews and Ratings

Couples may leave reviews and ratings about Professionals on the Platform.

Reviews must be honest, accurate, and based on a genuine experience with the Professional.

It is prohibited to:

• Post fake or misleading reviews
• Offer compensation in exchange for positive reviews

Professionals may report reviews they deem inappropriate. Mariages.io will review each report and reserves the right to remove reviews that violate these TCU.

13. Liability

Mariages.io acts as an intermediary and does not directly provide wedding services.

Mariages.io shall not be held liable for disputes between Couples and Professionals.

Mariages.io endeavors to ensure the availability and security of the Platform but does not guarantee uninterrupted or error-free access.

Users are solely responsible for the use they make of the Platform and the consequences thereof.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Mariages.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

The total liability of Mariages.io shall not exceed the amounts paid by the User in the 12 months preceding the event giving rise to the liability.

These limitations apply to the fullest extent permitted by Moroccan law.

15. Indemnification

The User agrees to indemnify and hold harmless Mariages.io, its directors, employees, and partners from any claim, loss, damage, or expense arising from:

Their use of the Platform

Their violation of these TCU

Their violation of any third-party rights

Content they have published on the Platform

16. Personal Data

The collection and processing of personal data are governed by our Privacy Policy, available on the Platform and in the application.

By using the Platform, the User acknowledges having read and accepted the Privacy Policy.

17. Cookies

The Platform uses cookies to improve the user experience.

The cookies used are:

• Essential cookies: necessary for the proper functioning of the Platform
• Analytics cookies: used to analyze usage and improve the Platform

• Advertising cookies: used to display relevant advertisements

19. Termination

Users may delete their account at any time from the application settings.

• Go to Settings
• Select My Account
• Click Delete my account
• Confirm your request
• Deletion is completed within 30 days
• Some data may be retained if required by law

Mariages.io reserves the right to suspend or delete any account that violates these TCU, without prior notice.

Upon account deletion, the provisions of the Privacy Policy regarding data retention remain applicable.

In the event of account suspension or deletion by Mariages.io, the User will be notified by email.

Mariages.io may terminate access to the Platform at any time for any reason:

• Violation of these TCU
• Fraudulent or abusive use of the Platform
• Upon request by a competent authority

20. Miscellaneous Provisions

These TCU are governed by Moroccan law.

Any dispute relating to the Platform shall fall under the exclusive jurisdiction of the competent courts of Casablanca.

In the event of a dispute, the parties agree to seek an amicable resolution before initiating any legal proceedings.

If any provision of these TCU is held to be invalid, the remaining provisions shall remain in full force and effect.

The failure of Mariages.io to exercise any right under these TCU shall not constitute a waiver of such right.

These TCU, together with the Privacy Policy and the Payment and Wallet Terms, constitute the entire agreement between the User and Mariages.io.
